When Is Sexual Assault Not a Crime?

MS. SMITH GOES TO WASHINGTON
by Shirley Smith

BuzzFlash,

A person shouldn't have to be a parent to find this whole process, regarding these sexual assaults on 7th and 8th graders, along with the physical assaults of choking them until they fainted ... criminal, and just another instance of the criminal GOP influence in our law, when it applies to someone who is connected with any of the influence of today's GOP who are in power.

Yavapai County Attorney Sheila Polk said Tuesday that the media have misrepresented the case, which she described as a hazing ritual.

Crooks and Liars: Republican Dad gets son off in AZ sex case

What's criminal here, also, is who's interpreting the law. Even hazing has abused and killed people, and, there were pictures, as well as testimony from these children. I don't care what these people choose to call this ... these are serious crimes.

Read the Police report, below, which is my last link. You don't have to have a law degree to understand that this is sexual assault, with threats, and physical assaults, choking these children until they fall down unconscious.

"They could have been charged with sexual assault," said Sue Eazer, supervisor of the Pima County Attorney's Special Victims Unit. "Sexual assault is oftentimes not motivated by sexual desire."

Eazer said she has prosecuted several sexual-assault cases involving objects being shoved into children's body cavities.

"It makes no difference to me if it is a male or female (victim)," she said, adding that intent can be a factor in cases of child molestation, where a parent might be accused of touching an infant while changing a diaper.

Families outraged at legislator's son's plea deal

This camp was a "leadership program" and these adult males were in charge of at least 25 children. Of course, they knew what they were doing because these children were told "not to tell." These are adult males doing this. Now, it is referred to as "hazing," how ridiculous (these were committed as punishments and with the delight of the abusers) and even hazing has been outlawed and has been known to kill students. These reports don't say whose "Leadership" camp this is, and why were these three males were chosen to be counselors to these students in a leadership program. How did they qualify for this? It's hard to believe that with so many accounts of this type of behavior ... these young adults could get off with just a slap on their wrists because of their influence of political connections and probably ... money.

Below is the actual police report, 27 pages. I think it speaks pretty clearly for itself. As this report stipulates, these so-called counselors saw the bottoms of these kids more than they did their tops. Wicked and monstrous. As a parent, after reading this, I'm even more enraged with this miscarriage of justice. It ends up protecting the perpetrators, instead of these traumatized children who are the victims and these acts were done repeatedly on this children ... repeatedly.  How sick is that?

Post Script: In the GOP-led world of crime and punishment, people get six months for protesting and can quite possibly go free for sexual molesting. Only in Bush's GOP America.

On Tuesday, Donte Smith and Ken Crowley will begin six-month sentences for protesting the SOA (soaw.org) [School of America, the US's school for training assassins]. ... Ken, who will be serving his sentence at a Beaumont, Texas federal prison, long time peace and justice advocate with Witness For Peace, and School of the Americas Watch. Unlike in the past when Ken has committed civil disobedience with the intention of being arrested, this year he was arrested for simply holding up the fence as a colleague climbed under. On the eve of his sentence, Ken has this to say: "Although my act of nonviolent civil disobedience was unintentional, I feel that my prison witness is very connected to the WFP mission of speaking against the horrors of war and militarism. Of course, it is meaningless without the ongoing work of grassroots opposition to the most violent country in the history of the world. Knowing that you, and many others, understand and work so hard to bring peace to our world will be a sustaining power." (indymedia)
