Libby May be on Trial for Perjury, But Bush and Cheney Should be on Trial for Treason

We all know that the Libby trial is legally about perjury, even though the damage done to the United States by the executive branch of our government was much more than a legal violation; it was an impeachable offense.

At the same time that Bush and Cheney were selling America a war on the basis of Iraq allegedly having Weapons of Mass Destruction, they had not the least bit of compunction about rendering inoperative a CIA employee who specialized in tracking the illicit transfer of WMDs that existed in reality -- not just in the propaganda playbook of the Neo-Con dead enders.

It wasn't just a legal issue that evolved into a perjury charge; it was treason.

Exposing an entire network of individuals and resources who worked with Valerie Plame -- while blowing her cover -- was something that you would expect of Al Qaeda (or Al Capone), not the White House.

But the White House did the damage, which makes them something more than cunning. It makes them dangerous to the national security interests of the people of the United States of America.

All of this isn't technically on trial, because the charges against Libby are narrowly focused.

But the implications of the Valerie Plame outing continue to get covered up in a fog of exculpatory smoke and mirrors by the GOP echo chamber.

Betraying one's country should not be lauded by an amen choir of highly-paid corporate media shills, unless treason is a new right wing "moral value."

Combined with the multi-pronged, insidious and unrelenting assault on our Constitution by the Busheviks, we don't have to worry about terrorists bringing down our democracy and endangering our well being.

Bush, Cheney and their cohorts are doing bin Laden's work for him.

As long as the Neo-Con dead enders are in power, the "enemy" is winning -- and winning big.

The Leak

I always thought that it might be this leak that would sink the bush&co. ship. Of all the crimes that they have committed this one seemed the most petty and vindictive and as such showed how truly vile and devoid of spirit these vapid souls are.

What'll it take? Our getting Congress to cut off all funding for the Iraq war, that's what.

What could happen:

Cheney will be indicted. He will resign and the search for the next Jerry Ford (ongoing, no doubt) will require that a proper political operative be found.

Now, who isn't a sitting member of the House or Senate (*Clean enough to pass muster in the Senate*) and is certain to pardon Cheney, Bush and the litany of others? Bush can't pardon his administration by law and neither can Cheney - but an outsider who wasn't involved can. Bush may try to hang on as long as possible, but the long arm of the law (civil and criminal) will come knocking - hopefully sooner than later. What to do? Have your nice clean new VP become president upon your resignation and then the pardons fly.

Who wants to be president so bad he can taste it?

Who will be loyal to his party?

Who is too old to consider running at the end of Bush's term?

Who is well liked enough to pass the Senate's advice and consent?

Seize Their Bloody Assets

The final act of justice to be brought against Bush/Cheney should be to seize every bloody dollar they have made off their crimes. I'm sure they think they can keep the money, and that's what keeps them going. Once they are depleted, give the money to New Orleans and to Iraq to rebuild.

Did Stalin care about the Court of Public Opinion ? Or Hitler ? Or any of the tyrants who have aspired to control the world. Oh, sure, they'd welcome positive poll ratings, but it is not required to achieve their goals. As Cheney has said, "It doesn't matter if they respect us as long as they fear us." Be afraid. There are two courts in session

One court will decide the fate of I. Lewis Libby.

The other court is the "court of public opinion" and it will decide much more than the fate of one man. It will decide the fate of everyone involved in the conspiracy against the Wilsons and, more importantly, the conspiracy of deception that led this nation into the mother of all war crimes, a war of aggression.

The court of public opinion, in a Democracy, provided we still have one, is the highest court in the land.

It and it alone decides who is guilty of crimes against the people. I have seen it act decisively twice in my lifetime.

Once in the case of Richard Nixon who won the 1972 election by a landslide and was forced from office just ahead of impeachment and a sure conviction in the Senate. By the time of Nixon's resignation, his poll numbers were in the sub-basement and it was clear what the people wanted, after the revelations of the Erwin Hearings and the House Judiciary Hearings which led to the articles of impeachment.

Then there was the case of Bill Clinton, a man who was guilty of nothing more than a character flaw and lying about adultery under oath, a "crime" committed every day in family court all over this nation and is very, very rarely ever prosecuted. The court of public opinion held that they did not want Clinton impeached, let alone convicted of anything.

Clinton was impeached, as the rabid right in the House refused to listen to the people, but was not convicted in the Senate, as Clinton's poll numbers reached the 70th percentile. Quite a few Goopers lost their jobs over it.

Which brings us to the current nightmare.

The Libby trial is about perjury and obstruction of justice by one man, under the law. While some pundits, oped and editorial writers will focus on the fine points of the law, thus throwing more dirt into the air, it is the job of the court of public opinion to see through all that, because it is not our job to decide anything about Mr. Libby, other than as his actions illuminate the big picture, which is our concern.

The defendants in our court are:

The executive: Including Mr. Bush, Mr. Cheney, Mr. Rove and others who were involved in a conspiracy to discredit one administration critic, among many, and, in the process, get rid of a non-proliferation expert, whose focus was Iraq and Iran, sinking an entire front company and possibly getting foreign assets killed, tortured or simply rendered incapable of any further benefit to us.

While the trial itself, is not about the conspiracy to deceive the people and our other elected officials into war, it is very much about that in the court of public opinion.

The Legislative: The court of public opinion is also concerned with those in Congress, who have consistently covered up for the executive on all counts. An example of this would be Pat Roberts of Kansas, the chairman of the Senate Intelligence Committee, who attempted to scuttle an investigation into the use of Intelligence by the White House, in the rush to war in Iraq. The Democrats had to literally close the senate doors, shutting it down, to get him moving again, and then the report came out as incomplete, flawed and basically a white-wash.

This administration, and their enablers/co-conspirators in Congress, not to mention the corporate news media, are guilty of the worst crimes against the people of this country and our Constitution in modern history.

The Right-wing echo chamber must not be allowed to win in the court of public opinion any more than a mob lawyer in an organized crime trial should be allowed to win, as they are as guilty as the people they support

It is up to those of us who see through the smoke and mirrors to see that they don't. How? By bringing unrelenting pressure to bear on Congress and the news media.

Every day, through emails, faxes, phone calls and/or our presence in D.C., let it be known that we will not tolerate anything less than full accountability. We have seen what happens when we, the, people are too quick to forgive our elected officials, without accountability for them. We saw it when Nixon was pardoned and Iran/Contra fizzled, with presidential pardons for those who were convicted of crimes.

No, not this time.

There must be accountability for the people of this incarnation of Republican skulduggery, or most of them will be back, to do us more harm in the future.

We forget about the "oath of office" taken by public officials

A person testifying in a court of law is required to swear or affirm that he/she will tell the truth, the whole truth. Almost 95% of perjury charges are never prosecuted, yet we are expected to put faith in what witnesses say.

Equally important is the oath of office required to be taken by most public officials before assuming the duties of their office. The Founding Fathers put the oath of office language in our Constitution in Article II for the President, our "Chief Executive," and in Article VI, Clause 3 for all other Federal and state officers.

When one takes the oath of office, he/she swears to God or affirms under penalty of perjury "to support the [U.S.] Constitution." When one so swears or affirms, he/she publicly agrees to carry out his/her duties "according to the law," NOT according to WHIM. Hitler and Stalin indeed acted according to whim.

The "oath of office" was so important that it was the subject of the VERY FIRST LAW
passed by the U.S. Congress on June 1, 1789. It is known as "Statute 1,First Congress."

The "oath of office" should be recognized as the most important rule of every public official; for the United States Constitution IS our rule of law, for all laws do (or must) flow from its language.
Any act or law that is contrary to the U.S. Constitution is, naturally, "unconstitutional" and has no force of law or reason to be obeyed. The U.S. Constitution should be adhered to rather than be circumvented. But that hope is weakened when citizens do not recognize it as our greatest heritage.

I forget what I read recently about this utter snake in the grass, but he's ass-deep in it. I'll never forget how he said Clinton should be wary of coming to the Carolinas...in other words, that he'd be assasinated. Why Helms hasn't already faced a firing squad is beyond me.
