Dave Lindorff: Why Nancy Pelosi Has it Wrong on Impeachment

House minority leader Nancy Pelosi (D-CA), in an interview with Lesley Stahl of CBS News, said impeachment would be "off the table" if Democrats take over the House of Representatives in November, calling it a "waste of time." She couldn't be more wrong, and most Americans know it.

While Pelosi was responding to a loaded question from Stahl, who couched impeachment in terms of Democrats' supposed desire to seek revenge if they retake Congress, Pelosi, who would become majority leader in a Democratic House, bought into Stahl's argument, saying that she'd be "satisfied" to see the president and vice president spending the remaining two years of their second term as "lame ducks."

What Stahl should have asked Pelosi was whether she thought that President Bush had violated the law and the Constitution, and whether she believed he has committed impeachable offenses.

The answer to that is clearly yes.

Just take the president's order to the National Security Administration to spy on Americans without first seeking a warrant. A federal judge in Detroit has already found that the president violated the Foreign Intelligence Surveillance Act (a felony) and the Fourth Amendment. That is an impeachable act, and one which Democrats and Republicans alike would punish if they understood the the implications of what the president has done. Given that the secret FISA court has only rejected a handful of warrant requests out of over 70,000 made since 1978, the only reason Bush could have decided to violate the law is that he is doing something so outrageous he knew the hand-picked, top-security-cleared FISA judges would have rejected it out of hand.

Or take the signing statements. This president has used so-called "signing statements" to render inoperative over 800 laws or parts of laws passed by Congress, claiming that he has the authority to do so because he is a commander in chief in time of war (the so-called "War" on Terror). Rep. Pelosi claims that if she becomes House leader, Democrats will want to pursue a positive, progressive political agenda, yet this will be clearly impossible if the president is allowed to simply continue issuing signing statements invalidating any laws passed by a Democratic Congress. Signing statements cannot be vetoed, and if Democrats were to attempt to pass legislation outlawing them, Bush could veto that legislation (or render it inoperative with a signing statement). The only way to stop this unconstitutional usurpation of the principle of tripartite government is to impeach the president for blatant abuse of power.

This too, is an issue that Republicans and Democrats should agree on, for if this president is permitted to ignore laws passed by the Congress, then subsequent presidents (perhaps a President Hillary Clinton or Barack Obama?) could also do it, citing the continuing "War" on Terror, and the Bush precedent.

Does Nancy Pelosi believe that the president's lies and deceptions and the conspiracy by the administration to trick the nation into a disastrous invasion of Iraq is not grounds for impeachment? Nearly 3000 Americans have died as a result of that deceit, and nearly 40,000 have suffered grievous wounds, while the US military has been stretched to the breaking point, leaving the country unable to respond to genuine threats. Surely the author of this ongoing national nightmare must be punished, so that future presidents will not attempt to do the same thing.

These are only some of this administration's crimes. Others include:

* Bush's role in attacking, and then covering up the attack on former ambassador Joseph Wilson and his CIA agent wife, Valerie Plame -- a crime that was committed to discredit Wilson and discourage reporters from looking more deeply into his revelation that the documents used to claim Iraq was trying to buy uranium ore from Niger were obvious forgeries, and into who was behind those forgeries in the first place.

* Bush's authorization of torture as a policy for captives in Afghanistan, Iraq and in the nebulous and borderless "War" on Terror. The president, in an act of desperation, has gotten the currently Republican Congress to ram through a bill granting retroactive immunity to all those, including himself, who authorized or engaged in torture, but this should not deter a Democratic Congress from seeking impeachment for an action that remains a violation of international law, that places American troops at greater risk, and that has destroyed America's image around the globe.

* Bush's criminally negligent handling of the Katrina disaster in New Orleans.

* The rot of corruption in the administration, highlighted by the Abramoff lobbying scandals, which clearly reach right into the Oval Office, despite the president's initial lie that he didn't know Jack Abramoff.

* Bush's refusal to testify under oath and on the record before the 9-11 Commission, and his refusal to provide officials and documents demanded by the commission regarding what the administration knew before the attacks and how it responded to what it knew. This obstructionism by the White House has been called close to an act of treason by former Sen. Bob Graham, who until the end of 2002 was the chair of the Senate Intelligence Committee, and who has said if he were currently in the House would be the subject of a bill of impeachment.

Rep. Pelosi may think Americans don't want impeachment, but, like many Democratic leaders, she's simply out of touch. Indeed, the congresswoman will find a resolution on impeachment on her own ballot when she goes home to San Francisco to vote this November (a resolution that is likely to pass handily).

Meanwhile, a new Newsweek magazine poll finds that fully 51 percent of all Americans believe that the president should be impeached - more than half of them saying this should be a priority. That same poll finds that 20 percent of Republicans think the president should be impeached, with one in four of those saying it should be a priority for the next Congress.

These are astonishing figures when you consider that support for impeachment of President Bill Clinton never got higher than 36 percent, even at the height of his impeachment process.

Maybe Rep. Pelosi should start listening to the voters, instead of to her campaign strategists.

More importantly, she and other Democratic - and Republican - members of the House should recall that oath they took when they assumed office, which commits them to "support and defend the Constitution of the United States against all enemies, foreign and domestic." The Constitution these days is under relentless assault by an enemy in the White House. Defending it is not a "waste of time" Ms. Pelosi; it is your sworn duty.

a gauntlet thrown

Yesterday at his press conference Bush was asked why no 1 had been held accountable for iraq even though he concedes now "mistakes were made"?, all of the punditry has looked at his response as the latest in the long line of "no, i'm not gonna fire rummy" statements he's been forced to make, but in his answer to the question Bush said, "if you wanna hold someone accountable for this war, i'm right here, i'm accountable."
Now how do you hold a sitting president (whose passed his self-proclaimed "accountability moment" in the 2004 election) accountable?
Last i checked, that's the purpose of impeachment, and Bush just threw down his gauntlet and dared congress to "hold him accountable" (impeach him).

Event to confront Pelosi on impeachment

We will present these to Pelosi's office on Hallowe'en Day, at her SF office, October 31, 11:30-2:30. There will be a press conference at 12:15. This is a non issue right now

If Pelosi had said the dems would impeach, that would be the only story out there right now. I can just hear the
O'Lielys and the Slimebaughs ranting and raving about it non stop for the next 2 weeks. There are much more important things to be talking about right now like Iraq, Foley, the failure of shrub's war on terrah. If the dems take back the house and Senate, meaning the Rethugs don't manage to steal the election again, the investigations from Conyers and Waxman will be begin. Once those investigations begin, the the flood gates will be open and Shrub/Cheney's crimes will be visible for everyone to see.

Olddem is correct, but.....

......even if Democrats lack the votes necessary for cloture in the Senate, the investigative process involved in passing a Bill of Impeachment in the House should document sufficient evidence for the Attorney General, appointed by the Democrat President, who takes office in 2009, to prosecute Bush, Cheney, Rumsfeld, Rice, etc. for their crimes. This isn't for revenge. The purpose for this is to deter the future Presidents from criminally abusing the office as Bush has done.

Pelosi

Pelosi is being pretty cagey. She says there will be no impeachment hearings.

Who says she will stick with that statement if Democrats gain control of the House and Senate? If she came out and told us that she would fry Bush and his cronies, Americans might not show up at the polls or vote for Democrats. Why do I say that? I don't think Americans are ready for another impeachment. The Clinton impeachment was a circus, but more importantly, it divided our nation. Pelosi couldn't say what she will actually do. That's good... get the Dems. in first, then take Bush to the woodshed.

Impeachment

What everyone seems to forget in all this impeachment talk is that even if the Democrats capture the House and pass a bill of impeachment for Bush and/or Cheney, it still won't mean a damn thing, because they will never have the 67 votes in the Senate needed to get rid of them. It will be as big a waste of time as was the impeachment of Clinton over a BJ.

Of course Bush should be impeached

But Dems have many other issues rather than impeaching Bush. Corruption, signing statements, goofed war, welfare for the rich, etc. I agree with Pelosi not to make Bush a martyr-figure.
Also, what has Bush always done? Those around him may fall but Bush, like you know what, floats.
Let's let Bush float until 2008 where he will symbolize everything Americans should hate about the Republican Party before we take back the presidency.

Impeachment...not

The only way we will ever discover (prove) even a small portion of the neo-con cabal's treasonous crimes is through impeachment proceedings. Will this happen? I seriously doubt it.

Yes, the opposition will capture the House majority and perhaps the Senate majority as well. Will this change anything? I seriously doubt it.

It is easy to become caught up in the 'us vs. them' mindset especially when a comeback seems close at hand but remember one thing...our government is severely broken.

The members of Congress NOT betrothed to SIGs, corporations, foreign governments or lunatic ideologies can be counted on one hand. How else can the ongoing rape of the Constitution be explained? Our elected legislators do not even read the legislation they vote on anymore.

When the Dems take control it will be business as usual because in essence, as a group they are cut from the same cloth as the Reps. Maybe the theme music will be better, maybe there will be a touch less sand in the vaseline but unless major changes occur, we will still be screwed.

We must demand that changes be made in campaign financing. We have to figure out some way to limit the control lobbyists have on elected officials. We have to take our Republic back. We have to demand the repeal of the recent legislation that rendered our Constitution and Bill of Rights into 'a goddamned piece of paper'.

I think we should put the Dems on notice. They have 2 years to undo the damage. We should demand impeachment, Congressional hearings, and a special prosecutor or two. These things are NOT up to Nancy Pelosi to decide, they are up to us.

Will the Dems deliver? I seriously doubt it.

Come 2008, if we didn't get our country back, we should throw the bozos out. Same in 2010,2012... ad infinitum. Eventually they will get the message that they are going to work for us.

My theory is to get rid of the really bad guys and then work on the merely incompetent. This includes quite a few Dems.
I would never advocate that other opinions (or political parties)interfere with your political football match.

Bush and impeachment

Assuming that articles of impeachment were drawn up and impeachment proceeded, without an overwelming Democratic Senate, it is a good chance that the Senate would declare that anyone responsible for the War were inoccent of any impeachable offence, can you imagine, with Bush's arrogance, what he would assume he could do then. We are in a hell of a mess right now, I am sure he could add to that.

Pelosi's first duty

...is to take back the House. Both Bush and Cheney should be impeached; if convicted, Pelosi will be president.

This fact, if no other, will cause her to keep an open mind.

Bush Impeachment

Representative Pelosi Cannot simply decide to not have a vote of impeachment against Mr. Bush or any other person that he appointed. If the Democrats should take back the HOUSE of REPRESENTATIVES, then Democrats will hold KEY POSITIONS in all of the committees and departments, John Conyers being one of those committee chairpersons. So if John Conyers should approach Mrs. Pelosi and show INCONTRAVERTABLE EVIDENCE, OR even just the possibility that Bush or any person he appointed was involved in or perpetrated any illegal activities, she then has no other option but to call for IMPEACHMENT OF THOSE INDIVIDUALS THAT ARE SUSPECTED OF ANY ILLLEGAL ACTIVITIES. if she (Mrs.Pelosi) doesn't call for impeachment after being shown evidence that our laws might have been broken, then she is in fact DERELICT IN HER DUTIES and she herself should be removed from that position.
I believe she is making those statements to show that she herself is not interested in impeachment at this time, however I further believe that the minute someone else brings the goods for impeachment, she(Mrs. Pelosi) will jump on that bandwagon so fast that our eyes will spin. It is just another part of that game WE THE PEOPLE call POLITICS.
